1. Acceptance of Terms

By accessing and using amigo.gg ("the Platform"), operated by Amigo Softcom LLP, a limited liability partnership registered in India with its registered office at C-1202, Bestech Park View Spa, Sector 47, Gurgaon, Haryana — 122018, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Platform.

2. About the Platform

amigo.gg is a B2B marketplace that connects restaurant supply buyers with verified brands and their authorized dealers across India. We act as an intermediary platform and do not directly sell, manufacture, or distribute any products listed on the Platform.

3. User Accounts

  • You must provide a valid Indian phone number to register.
  • You are responsible for maintaining the confidentiality of your account.
  • You must be at least 18 years of age to use the Platform.
  • Business accounts must provide accurate company information including GSTIN where applicable.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Buyer Terms

  • Buyers can browse products, send inquiries, and communicate with brands and their authorized dealers through the Platform.
  • The Platform facilitates lead generation; all purchase transactions, negotiations, and agreements are directly between buyers and brands/dealers.
  • amigo.gg does not guarantee product quality, pricing, availability, or delivery timelines.
  • Buyers are responsible for conducting their own due diligence before engaging in transactions.

5. Brand & Dealer Terms

  • Brands and dealers must provide accurate and truthful product information, including descriptions, pricing, and images.
  • Brands are solely responsible for the quality, safety, and legality of their products.
  • Product listings must comply with all applicable Indian laws and regulations.
  • Brands and dealers must respond to buyer inquiries in a timely and professional manner.
  • Misleading product information or fraudulent activity will result in listing removal.
  • Brands and dealers must hold all necessary licenses and permits required for their business.

6. Prohibited Activities

Users must not:

  • List counterfeit, illegal, or prohibited products
  • Provide false or misleading information
  • Spam other users with unsolicited communications
  • Attempt to circumvent the Platform to avoid inquiry tracking
  • Scrape, crawl, or use automated means to access the Platform without permission
  • Impersonate another person or business
  • Upload malicious content or attempt to compromise Platform security

7. Intellectual Property

The Platform design, logo, and content created by amigo.gg are our intellectual property. Product listings, images, and descriptions uploaded by brands remain the property of their respective owners. By listing content on the Platform, brands grant us a non-exclusive license to display it on the Platform.

8. Limitation of Liability

amigo.gg is a marketplace platform and:

  • Does not guarantee the accuracy of product listings or brand information
  • Is not responsible for transactions conducted between buyers and brands/dealers
  • Is not liable for any damages arising from the use of the Platform
  • Does not guarantee uninterrupted or error-free service
  • Is not responsible for any loss or damage resulting from unauthorized access to user accounts

9. Dispute Resolution

Any disputes between buyers and brands/dealers are to be resolved directly between the parties. amigo.gg may, at its discretion, mediate disputes but is not obligated to do so. Any disputes relating to these Terms shall be governed by the laws of India and subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms. We will make reasonable efforts to notify users of significant changes.
